I am here on this forum to have a little discussion.
Lets assume that, I have a start up venture of floral decoration. You all know in service industry website plays an important role. I prepared wonderful website with very attractive design and content.
Somehow I came to know that my website design and content are stolen by some other florist. Same design is visible on that website.
Designs is main part for any floral decorator, which helps to gain more customers.
In such situation, what necessary steps should I need to take against that offender?
Send DMCA notice to that florist company. This will help you in greater way and make sure that their design should get change.
Very first step of mine will be that I will search location of website hosted, who is the owner of website? Will get in touch with them as soon as possible.

Many of them don't entertain your mails and notice. They just ignore your request or "abuse" mail request.
Contact ISP and request them to take their website down. Provide proof that design is yours and they don't have authority to use. ISP will suspend their website.
According to Digital Millennium Copyright Act, one has provision to deal with intellectual property theft online. Fill template of formal notice and send it to website owner. Because of that many hosting providers will immediately reply to your mail.
I agree to all, but anyone didn't suggest anything about, what to do? If they don't reply to our notice, emails. Please elaborate this point also.

Call them publically. If your blog and forum has huge amount of visitors then you might get others to join your cause and support you to get the offending website down.

Hmm, right!! This will bring them down and I think this is any how better than getting into legal issue.

Getting into legal is very last option. Don't consider this option before. If you are not getting any response from their side than hire a lawyer. Lawyer will send them an official cease and desist letter. Letter would likely to state that design, they are using is copyrighted material and they need to take website down or face further legal action.
Get in contact with the other company and make them understood that you have already used those design.
You can give notice to its user, and is still it continues, you can sue them.
